OSH Act of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible wood dust fire hazards while working at or near an indoor enclosureless dust collector unit which was being utilized with equipment recognized by the woodworking industry of having a history of producing frequent sparks (a wide belt sander having a mechanical material feed system) and other woodworking equipment (an edgebander having a mechanical material feed system as well as a CNC machine and a bore and insert machine):    a)    Midwest Commercial Millwork, Inc. - Lima, Ohio: On or about May 5, 2015, a Dantherm indoor enclosureless dust collector unit (serial number 324432) was used to collect combustible wood dust from a wide belt sander (TimeSavers; serial number 20912) with a mechanical material feed system, an edgebander (Holzher; serial number 4719/0-710) with a mechanical material feed system, a CNC machine (Weeke; serial number 0-25-13-0498) and a bore & insert machine (Omal; serial number 9577), exposing the operator and any nearby employees to fire hazards.      Among other methods, a feasible and acceptable method to correct this hazard would be to comply with the National Fire Protection Association (NFPA) NFPA 664 "Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, 2012 Edition" Sections 8.2.2.2.2, 8.2.2.5.1.4(7).  Specifically, for the indoor enclosureless dust collector connected to equipment having a history of producing frequent sparks, locate the dust collector outdoors and provide a listed method of spark detection and extinguishment within the main duct and upstream of the dust collector.
