29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Roof, new townhome construction located at 370 Rose Garden Lane, Alpharetta, GA 30009: Employees were exposed to falls while working on a 8/12 pitched roof at eave heights of approximately 32-feet, 5-inches from ground level without a fall protection system in place. Employees were wearing full body harnesses with no connection to a life-line and approved anchor point.

29 CFR 1926.502(d)(17): The attachment point of the body belt was not located in the center of the wearer's back. The attachment point of the body narness was not located in the center of the wearer's back near shoulder level, or above the wearer's head. (a) Roof, new townhome construction located at 370 Rose Garden Lane, Alpharetta, GA 30009: Employee using positioning belts/mountain climbing harnesses on a 8/12 pitched roof at heights of approximately 32-feet, 5-inches used an inadequate fall arrest system when the attachment to the body harness was not made on the wearer's back. Employee attached a life-line to a caribineer located in the front webbing of the mountain climbing harness which is located at the wearer's waist. A positioning device can not be used as a personal fall arrest system.
