29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: (a) Construction site - On or about May 8, 2015 the employer did not provide hazard recognition training for employees performing activities including, but not limited to, trenching and excavation. An employee working in an unprotected excavation had not been trained on the requirements contained in 1926 Subpart P, Trenching and excavation. The employee did not know when cave in protection was required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): (a) Construction Site - On or about May 8, 2015 an employee was working within the west end of an unprotected excavation that was 6' 2" deep, 14'10" long, and 6' wide on east end and 8' wide on west end in type "C" (previously disturbed) soil with near vertical walls. The lower section of the south wall was partially bell shaped.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench/excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: (a) Construction site - On or about May 8, 2015 employee was working in excavation 6' 2" deep and no safe means of egress was located in the trench. Employee was lowered into the trench with the bucket of an excavator.
