OSH ACT of 1970 Section (5)(a)(1): Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to: a struck-by hazard. a) Jobsite - On or about August 11, 2020, at a worksite located at W. Crouch St., Hollandale MS, employees were exposed to struck-by hazards when the boom of an excavator being driven down a street caught on overhead lines and pulled down part of a utility pole, transformer and wires .

29 CFR 1926.602(a)(9)(i): All bidirectional machines, such as rollers, compacters, front-end loaders, bulldozers, and similar equipment, shall be equipped with a horn, distinguishable from the surrounding noise level, which shall be operated as needed when the machine is moving in either direction. The horn shall be maintained in an operative condition. a) Jobsite - On or about August 20, 2020 the John Deere 330 CLC, excavator horn and reverse alarm was not working, exposing employees to a struck-by hazard.
