29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Location: Concrete wall supporting the hoppers at the Concrete Processing Plant at 608 Main Street, Mashpee, MA. Employees were exposed to fall hazards greater than 9 feet to the outside and ground, and greater than 24 feet to the inside of the hopper, while climbing over the concrete wall from one ladder to another, where Employees had to travel down a length of the concrete wall to access the descending ladder.

29 CFR 1926.1053(b)(6): Ladders were used on surfaces which were not stable and level: Location: Aggregate hoppers at the Concrete processing plant located at 608 Main Street, Mashpee, MA. An Employee fell and was injured while cutting 1/2 inch bolts with an oxygen and acetylene torch, where the ladder slipped from under him due to its placement on the tapered/sloped metal side of an aggregate hopper.
