29 CFR 1926.1053(b)(9): The area around the top and/or bottom of (a) ladder(s) was not kept clear:  a) For the construction site at 2810 North 35th St., Tampa, FL 33605, as observed/occurring on or about 05/19/2015, employees were exposed to fall hazards of 14 ft. at the top exit point of a portable extension ladder. The ladder accessed the second floor of the building and the top area near the ladder had a latched gate that was approximately 16 inches from the top of the ladder. The gate impeded employees' access to the upper level and employees had to stand in a 16 inch. wide area to unlatch the gate exposing them to a 14 ft. fall onto the concrete floor below.
