29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1). a) On or about March 2, 2015 (or there about), at the TVA Plant located at 1499 Steam Plant road in Gallatin, TN, a contractor's employees were exposed to asbestos when they removed an expansion joint that the building owner did not determine the presence, location and quantity of asbestos containing material (ACM) prior to removal. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1101(k)(3)(ii)(B): The employer did not inform employers of employees who worked and/or were working in adjacent areas of the location and quantity of asbestos containing material and/or presumed asbestos containing material present in the area. a) On or about March 2, 2015 (or there about), at the TVA Plant located at 1499 Steam Plant road in Gallatin, TN, a contractor's employees were exposed to asbestos when they removed an expansion joint that the building owner did not determine to be asbestos and inform employers of employees who worked and/or were working in adjacent areas of the location and quantity of asbestos containing material and/or presumed asbestos containing material present in the area. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
