29 CFR 1918.85(j)(3): The employer did not ensure that each employee exposed to a fall hazard was protected by a fall protection system meeting the requirements of 29 CFR 1918.85(k). a) Loading Bay 28 Deck of the MV Breman Express Berth 2 Wando Welch Terminal: On or about May 16, 2015 at 11 p.m. a Hatch Tender/Paper Man was walking on the lashing platform when he stepped into an open manhole where he fell approximately 10 feet to the deck below. He was not protected from falls by fall protection systems or by having the manhole covered.
