29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:      Affordable Exteriors project site at 7503 Feith St. Weston, WI: Affordable Exteriors LLC did not develop and maintain a safety and health program to include frequent and regular inspections of the jobsite to be made by competent persons designated by the employer.  Such inspections by a competent person would have identified and addressed unsafe jobsite conditions such as the proper use of PPE, damage electrical cords, set up and use of ladders and scaffolding, no fall protection provided working above six feet.

To abate these hazards the employer must ensure employees have been trained to recognize and avoid unsafe conditions, to understand the OSHA Standards relating to construction activity, and the methods needed to control or eliminate hazards which could lead to injury or illness.    Affordable Exteriors LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 317749893, citation number 1, item number 3, and was affirmed as a final order on 2/2/15, with respect to a workplace located at 201 N. Hugo Ave. Duluth, MN 55812.    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including copies of the training materials and the names and qualifications of the persons it is designating as competent.

To abate this hazard the employer must ensure that each employee is trained to recognize fall hazards, the OSHA regulations applicable to fall protection during construction activity, and to properly set up and use fall protection systems appropriate for each project site.  Affordable Exteriors LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 317749893, citation number 1, item number 3, and was affirmed as a final order on 2/2/15, with respect to a workplace located at 201 N. Hugo Ave. Duluth, MN 55812.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including the names and qualifications of the persons it is designating as competent, and a description of their responsibilities.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     Affordable Exteriors project site at 7503 Feith St. Weston, WI: Each employee on a steep pitch roof, with unprotected sides and edges, is not protected from falling by any form of fall protection. The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed at 7503 Feith St. Weston, WI 54476, where seven employees were not protected from fall hazards between 9 feet and greater than 30 feet to the ground.      To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than 6 feet above a lower level without adequate fall protection.     Affordable Exteriors LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 317749893, citation number 1, item number 2B, and was affirmed as a final order on 2/2/15, with respect to a workplace located at 201 N. Hugo Ave. Duluth, MN 55812; and was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 967492, citation number 2, item number 1, and was affirmed as a final order on 7/22/15, with respect to a workplace located at Stoney River Memory Care, Marshfield, WI 54472; and was previously cited for a violation of this occupational safety and health standard, or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 317312338, citation number 1, item number 2, and was affirmed as a final order on 8/10/14, with respect to a workplace located at 2231 W. 3rd St. Duluth, MN 55806.    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.
