Employee(s) were not instructed to recognize and avoid unsafe conditions and were not trained as to what OSHA regulations applied to them at the job site so that they could control or eliminate any hazards or other exposure to injury while engaging in trenching and excavation operations.    Violation observed on or about 05/11/2015.

29 CFR 1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)   Work Site:  30 Estling Lake Road, Denville, NJ    Employees working in the up to 7 1/2 ft. deep trench were exposed to head injuries from stones adjacent to the trench's edges falling into the trench or from equipment being used around the trench as the employer had not provided for hardhats to be worn.                             Violation observed on or about 05/11/2015.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    a)  Work Site:  30 Estling Lake Road, Denville, NJ    Even though the trench had visible deficiencies, such as but not limited to, no protective cave-in system with a depth of up to 7 feet, 6 inches, exposed employees were not removed from the hazardous area by the competent person until the necessary precautions had been taken to ensure their safety.      Violation observed on or about 05/11/2015.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):      a) Work Site:  30 Estling Lake Road, Denville, NJ.    Laborers working in a trench were exposed to struck-by and crushing injuries in the up to 7 foot, 6 inch deep trench which was not adequately sloped or protected by shields or shoring.                                                                     Violation observed on or about 05/11/2015.
