29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) Construction site, The Promenade, front of building - On or about May 12, 2015, employees washing newly installed brick facing, accessed/egressed a tube frame scaffold from a balcony 4 feet below the working level by climbing on the cross braces and scaffold frame exposing employees to a fall hazard of more than 10 feet to the ground.

29 CFR 1926.451(g)(4): Guardrail systems installed to meet the requirements of this section did not comply with the provisions listed in subparagraphs (i) through (xv) of this paragraph: a) Construction site, The Promenade, front of building - On or about May 12, 2015, employees washing newly installed brick facing, worked from a tube frame scaffold without a guardrail system meeting all requirements of subparagraphs (i) through (xv), including but not limited to un-guarded platform ends and top/mid-rail to the rear. Without a complete guardrail system, employees were exposed to a fall hazard of more than 10 feet.
