OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who use overhead hoists which are either not properly secured to the structure or have slack load chains:    a)  Shop - On or about May 26, 2015, the hoists in use did not have their suspension hooks secured to a fixed point of the building's structure as the hoists were attached to an unsecured metal bar laying which was only laid across the ceiling beams.     b)  Shop -  On or about May 26, 2015, the slack load chain was not encased in a container creating a entanglement hazard to the employee operating the hoist.    Among others, one reasonable and acceptable method of abatement is to follow ASME B30.16.1993 entitled "Overhead Hoists," under Section 16-1.3.2(a) Support which states "The supporting structure, including trolleys, monorail, or crane, shall be designed to withstand the loads and forces imposed by the hoist for the rated load" and 16.1.3.3(g) Location which states "where the slack load chain hanging from the hoist may create a hazard to operations or personnel, a chain container recommended they the hoist manufacture or qualified person should be used".

29 CFR 1910.179(j)(2): The following items were not be inspected for defects at intervals as defined in paragraph (j)(1)(ii) of this section or as specifically indicated, including observation during operation for any defects which might appear between regular inspections:    a)  Shop - On or about May 26, 2015, the hoists used to lift lawnmowers have not been inspected prior to use to identify defects and safety hazards.
