29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    a) Jobsite - Employees were not provided with a safe means of access and/or egress to the tubular welded frame scaffold platform, exposing employees to a fall hazard of approximately fourteen (14) feet.  Employees were using the side frame of the scaffold to access and/or egress the working levels.  Observed on or about May 27, 2015.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a) Jobsite - Employees performing stucco operations from the 2nd level of the tubular welded frame scaffold were exposed to fall hazards of approximately fourteen (14) feet without the use of personal fall arrest systems or guardrail systems. Observed on or about May 27, 2015.

Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.    a) Employees were performing brick operations on a tubular welded frame scaffold that was not erected by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection. 29 CFR 1926.451(c)(3): Supported scaffold poles, legs, posts, frames, and uprights shall be plumb and braced to prevent swaying and displacement.    a) Jobsite  - Employees working from a supported tubular welded scaffold were exposed to fall hazards of approximately fourteen feet (14) due to the swaying and displacement of scaffold poles, legs and posts as a result of the normal working procedure. Observed on or about May 27, 2015.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    a) Jobsite - Employees were engaged in moving materials from a pallet located on a rough-terrain type forklift which required the employees to move from the tubular welded scaffold to the pallet and back.  Employees were exposed to fall hazards of approximately forty-five (45) feet above grade. Noted on or about May 27, 2015.
