29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    a) On or about 6/3/15 at a residential new build located on Darien Court, Lancaster, New York; employees roofing a new house were working from the roof and a ladder jack scaffold. The slack in the rope the employee was attached to hung down past the eaves and scaffold platform allowing potential free fall distances greater than 6 feet.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:    a) On or about 6/3/15 at a residential new build located on Darien Court, Lancaster, New York; an employee roofing a new house was wearing a body harness that was not over his shoulders and upper body. The attachment point of the harness was at or near the employee's hips.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) On or about 6/3/15 at a residential new build located on Darien Court, Lancaster, New York; employees roofing a new house were working from the roof that had a pitch of 6 in 12 and an eave height of approximately 18 feet. Employees were not wearing or utilizing fall protection.    NO ABATEMENT CERTIFICATION REQUIRED    The employer, Irish Pride Services, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 977910, citation number 2, item number 1 and was affirmed as a final order on 6/17/14, with respect to a workplace located at 42 Newberry Lane, Lancaster, New York.    The employer, Irish Pride Services, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 543545, citation number 1, item number 1 and was affirmed as a final order on 8/20/12, with respect to a workplace located at 10 Wetherby Way, Lancaster, New York.
