29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) For the construction site at 2510 Gulf Dr. N, Bradenton Beach, FL as observed on or about 06/03/2015, employees were exposed to fall hazards up to 15 ft. out of a window opening while working off of a horse type scaffold assembled from a step ladder, and a plank.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a) For the construction site at 2510 Gulf Dr. N, Bradenton Beach, FL as observed on or about 06/03/2015, employees were exposed to fall hazards up to 15 ft. out of a window opening while working off of a horse type scaffold assembled from a step ladder, and a plank. This was not the intended use of the ladder, in that, the ladder was not designed to be used as a scaffold platform per its warning labels.

29 CFR 1926.451(b)(2): Scaffold platforms and walkways were not at least 18 inches wide:  a) For the jobsite at 2510 Gulf Dr. N, Bradenton Beach, FL, as observed on or about 06/03/2015, employees worked off of a horse type scaffold erected from an A-frame stepladder and a plank resting on the ladder and an adjacent floor level. The platform/plank was only 11.5 inches wide.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazard:  a) For the jobsite at 2510 Gulf Dr. N, Bradenton Beach, FL 34217, as observed on or about 06/03/2015, employees were exposed to fall hazards while working/walking at unguarded open windows. Employees had not been through fall protection training and were not aware of how many pounds an anchor point was required to hold. Guardrails were missing throughout the 2nd and 3rd floors where window openings existed.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a) For the residential construction site at 2510 Gulf Dr. N, Bradenton Beach, FL, as observed on or about 06/03/2015, employees were exposed to fall hazards of 34 feet while walking/working by unguarded window openings.  H.E.E. Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1047398, citation number 1, item number 1, and was affirmed as a final order on 05/08/2015, with respect to workplace 306 65th St., Holmes Beach, FL 34217.
