A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    a.  On or about June 9, 2105, at the above addressed jobsite, an employee conducting water line installation in a trench,  five (5') feet eight (8") inches in depth, were not provided with means of egress.

Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    a.  On or about June 9, 2015, at the above addressed jobsite, an employee installing a water line in a excavation was not protected from materials falling into the excavation, in that the spoil pile was less than two (2) feet from the edge of the excavation.

29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    a.  On or about June 9, 2015, at the above addressed jobsite, the competent person was aware of an excavation with a hazardous condition, lack of cave in protection.  The competent person did not remove the exposed employee(s) from the hazard, thereby exposing employees to hazards associated with trench collapse.

On or about June 9, 2015, at the above addressed jobsite, an employee working in a trench did not wear a hard hat to protect against falling material and debris.      The Mango Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number 494678, citation number 2, item number 1 and was affirmed as a final order on September 12, 2012, with respect to a workplace located at 138 Callan, Evanston, IL 60202.
