29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: a) Exterior, Southeast Corner of Building - A mason was observed chipping existing brick from the corner using a brick chisel and hammer and not wearing eye protection, on or about 06/11/2015. b) Exterior, Southeast Corner of Building - A laborer was observed hand mixing Brick-Loc brick mortar which contained Portland Cement and not wearing eye protection, on or about 06/11/2015.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) Exterior, Southeast Corner of Building - A mason was observed chipping out existing brick while standing on a tubular welded frame scaffold work platform and exposed to a 15 ft., 10 inch fall hazard, on or about 06/11/2015. Hernandez Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 909256, citation number 1, item number 2, and was affirmed as a final order on September 09, 2013, with respect to a workplace located at 610/612 M Street, NW Washington DC.
