On or about 15 June 2015, and at time prior thereto, an employee was handing and throwing materials and tools up to another employee above to perform framing activities, exposing the employee to the hazard of being struck by from falling materials, tools, and debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about 15 June 2015, and at times prior thereto, a worker was performing framing activities along the ridgeline of a residence under construction at the roof of the second story without fall protection, exposing the worker to a fall hazard of approximately 9.5 to the second story floor below or 28 feet to the ground.
