29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition. Employees were allowed to use fork lifts that were found to be in need of repair due to the following instances: a. A forklift with a factory installed seat belt was found to have the seat belt damaged. b. A forklift had a broken windshield that impaired vision while employees were lifting loads. These conditions exposed employees to struck-by and caught between hazards.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not netralized, power was not shut off, and brakes set In the South part of the shop, an unattended fork lift was left with it's loading engaging means not fully lowered. This cndion exposed employees to struck by hazards.
