29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, are not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  a) Hernandez Roofing at the address of 2533 W. Village Rd. Toledo, OH: The employer does not ensure employees are wearing appropriate eye protection such as, safety glasses while using a pneumatic nail gun to fasten roofing material. The employees using these tools are exposed to potential eye injuries from flying objects. This was most recently observed on June, 23, 2015.  Hernandez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.95(a), which was contained in OSHA inspection number 444453, citation number 2, item number 1a and was affirmed as a final order on August 13, 2012, with respect to a workplace located at 1002 Main St. Genoa, OH.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system nor are employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a) Hernandez Roofing, at the address of 2533 W. Village Rd. Toledo, OH: The employer does not require the use of any form of fall protection during roofing work. The violation was most recently observed on June 23, 2015, where employees are not protected from a 16 foot fall to the ground below. To abate this hazard the employer must ensure that its employees performing roofing work are protected from falls, and no employees are allowed onto a roof more than 6 feet high without adequate fall protection.  Hernandez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 444453, citation number 2, item number 1b and was affirmed as a final order on August 13, 2012, with respect to a workplace located at 1002 Main St. Genoa, OH.    Hernandez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 107714, citation number 2, item number 2 and was affirmed as a final order on December 2, 2011, with respect to a workplace located at 1250 Lallendorf Rd. Oregon, OH.
