29 CFR 1910.23(c)(1): Open sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings, or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v), on all open sides and edges:  a)  On the Roof of the Facility - On or about June 26, 2015, an employee, inspecting anhydrous ammonia system valves and gauges daily, was exposed to a fall hazard of more than 15 feet above the ground because there was no continuous guardrail system in place to guide his path of travel and protect him from falling off of the roof.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a)  Around the Anhydrous Ammonia System - On or about June 26, 2015, the employer had not established nor implemented a written respiratory protection program, including, but not limited to a  pre-use medical fitness evaluation; annual fit testing; training in the proper use and limitations, care for, and possible health hazards involved in using respiratory protective equipment; and an ammonia cartridge changing schedule for employees maintaining and repairing the Anhydrous Ammonia System.  No abatement certification or documentation required.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a)  Throughout the Facility - On or about June 26, 2015, the employer had not developed, implemented, or maintained, a written hazard communication program which at least described how the criteria specified in paragraphs (f) Labels, (g) [Material] Safety Data Sheets, and (h) Training was being met for employees using chemicals such as but not limited to anhydrous ammonia, hydrochloric acid, and battery acid at the time of their assignment in their work areas.      No abatement certification or documentation required.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a)  Throughout the facility - On or about June 26, 2015, the employer had not provided employees with effective information and training on the health and physical hazards associated with anhydrous ammonia, hydrochloric acid, and battery acid at the time of their assignment in and around those work areas.    b)  Throughout the facility - On or about June 26, 2015, the employer had not conducted training on the revised HCS 2012 shipping container labels, the hazard pictograms, and safety data sheet organization for the workplace hazardous chemicals, such as anhydrous ammonia, hydrochloric acid, and battery acid so that the employees could find and apply the SDS hazard information.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
