OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Sacpa Holdings LLC dba O'Charley's #2103, 2077 Interchange Rd, Erie, Pa, 16509: Fry station: On or about June 24th, 2015, and times prior thereto, the employer failed to provide a place of employment free from the recognized hazard of burn injuries resulting from contact with hot grease in the deep fryers. Employees periodically stepped onto and/or climbed onto the edges of the deep fryers while the hot grease reservoirs were covered with baking sheets. Employees would conduct cleaning operations of the apex and hood areas above the fry stations while standing on the edges of the deep fryers.

Portable fire extinguishers including, but not limited to, multi-purpose fire extinguishers and class K fire extinguishers were made available for employee use in the work areas. The fire extinguishers were not inspected at least monthly.
