On or about June 29, 2015, and in times prior thereto, employees were constructing the ceilings over the balconies while standing on sawhorses that did not have platforms at least 18 inches wide, exposing the employees to a fall hazard.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. On or about June 29, 2015, employees were using sawhorses to gain height for constructing the ceilings over the balconies on the residential building under construction without being trained to recognize the hazards of working from scaffolding, exposing employees to the hazards of falls.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented: On or about June 29, 2015, employees were installing the ceilings over balconies on the residential apartment complex under construction up to approximately 27 feet high without protection from falls, exposing the employees to a fall hazard. The Maverick Framing & Building Materials Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 315302547, citation number 1, item number 2 and was affirmed as a final order on December 26, 2011, with respect to a workplace located at 4500 Highway 57, Gautier, MS. 39564.
