29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:  In the back room, gloves were not worn while troweling Portland cement on the floor and while dipping hands into a bucket of water, with Portland cement residue, and splashing the water on the Portland cement on the floor.  Gloves were available onsite, but they were not worn.  The project foreman could observe the activity from his location onsite.  Employees were exposed to the hazard of contacting Portland cement.  ISAGANI B. BALUYUT CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.95(A) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1026348, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON MAY 15, 2015, WITH RESPECT TO A WORKPLACE LOCATED AT THE NEW FOREVER 21 RETAIL STORE PROJECT, SAN PEDRO ROAD, TAMUNING, GUAM.

29 CFR 1926.1053(b)(4): Ladders were not used only for the purpose for which they were designed:  In the dressing room area, an 8 foot long step ladder was used in the folded up position.  Employees, standing on the fifth rung while using a screw gun to secure drywall to steel studs, were exposed to the hazard of falling to the concrete floor.
