29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards shall be guarded with a standard railing and toe board. a) At the establishment, employees observing a vacuum container cleaning operation stood on a working surface, approximately 2.5 feet wide that was located on the unprotected side of a standard railing, between the railing and a half-round tank. The employees were not protected from falls as great as 17.5 feet from the walking surface to the bottom of the half-round tank. b) At the establishment, employees working next to half-round tanks, in the area where trucks back up to unload the contents of vacuum containers, were not protected from falls as great as 17.5 feet from the walking working surface to the bottom of the half-round tank.

29 CFR 1910.146(c)(1): The employer shall evaluate the workplace to determine if any spaces are permit-required confined spaces. NOTE: Proper application of the decision flow chart in Appendix A to section 1910.146 would facilitate compliance with this requirement. a) At the establishment, the company performed atmospheric testing of vacuum containers as part of the company's screening process for the acceptance of the containers. Vacuum containers passing the company's acceptance screening process could sit at the company waiting to be cleaned for hours or days. Employees entered the vacuum containers without pre-entry atmospheric testing being performed exposing employees to hazardous atmospheres.
