OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards as a result of operating and/or working near propane burners lacking means to prevent employee or minimize employee exposure in the event of an explosion and or other uncontrolled fire event. On July 8, 2015, the employer exposed employees to fire and explosion hazards that were created by a propane-operated Webster Combustion Burner. The burner and surrounding equipment were inadequately maintained and/or installed, which caused the release of highly flammable propane gas that led to an explosion that injured an employee. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(c)(2)(iv): Power-operated industrial trucks designated as DY, EE, or EX may be used in locations where volatile flammable liquids or flammable gases are handled, processed or used, but in which the hazardous liquids, vapors or gases will normally be confined within closed containers or closed systems from which they can escape only in case of accidental rupture or breakdown of such containers or systems, or in the case of abnormal operation of equipment; also in locations in which hazardous concentrations of gases or vapors are normally prevented by positive mechanical ventilation but which might become hazardous through failure or abnormal operation of the ventilating equipment; or in locations which are adjacent to Class I, Division 1 locations, and to which hazardous concentrations of gases or vapors might occasionally be communicated unless such communication is prevented by adequate positive-pressure ventilation from a source of clear air, and effective safeguards against ventilation failure are provided. Employees were exposed to fire and explosion hazards while working in the Block Production Area near equipment such as, but not limited to, powered industrial trucks and the employer did not ensure that equipment was intrinsically safe and approved for the hazardous location and the ignitable properties of gas present. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
