29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  The employer does not ensure that employees are protected when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. This violation was observed on or about July 08, 2015, at the construction site when employees were exposed to a stuck-by hazard while operating a nail gun without eye and face protection.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are using eye and face protective equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).   The employer does not ensure that each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system.  This violation was observed on or about July 08, 2015 when employees were exposed to a fall hazard greater than 6 feet when performing roofing work without a fall protection system.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are protected by guardrail systems, safety net system, or personal fall arrest system.
