29 CFR  1926.25(a):During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:  On or about December 13, 2021, at a residential construction site in Katy, TX employees were exposed to a struck by hazard, while working on a house while metal and wood construction debris was accumulated with sharp and protruding  points of impact.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about December 13, 2021, at a residential construction site in Katy, TX, employees were exposed to a fall hazard of more than 6 feet while working on the roof of a house without the use of any fall protection system.  Benito Cuevas was previously cited for a violation of this Occupational Safety and Health Standard, found in 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1563021, citation number 2 item number 2 and was affirmed as a final order on 1/25/2022 with respect to a workplace located at 8105 Ocean Jasper Lane, Texas City, TX 77591.  Benito Cuevas was previously cited for a violation of this Occupational Safety and Health Standard, found in 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1487870, citation number 1 item number 2 and was affirmed as a final order on 9/01/2020 with respect to a workplace located at 56 Venetia Grove Drive, Tomball, TX 77375.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about December 13, 2021, at a residential construction site in Katy, TX employees were exposed to a fall hazard of more than 6 feet while working on the roof of a house without a ladder extending 3 feet above the roof's edge or being secured.  Benito Cuevas was previously cited for a violation of this Occupational Safety and Health Standard, found in 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1563021, citation number 1 item number 1 and was affirmed as a final order on 1/25/2022 with respect to a workplace located at 8105 Ocean Jasper Lane, Texas City, TX 77591.
