29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    On or about July 9, 2015 the employer failed to adequately train employees in recognition and avoidance of trench hazards, rigging equipment and trench protective systems.    Instance A: Rigging equipment inspections for load rating tags permanently attached to chain slings for various hitch types.  Instance B: Weights of material to be rigged and move by mechanical equipment (trench box/shield).  Instance C: Depth requirements for ladders for safe entry and exit into trenches greater than four feet in depth.  Instance D: Trench box/shield systems manufacturer's tabulated data and assembly instructions for required system components (spreader pins).  Instance E:  Determine if was necessary to monitor for harmful levels of atmospheric contaminants that could be released from damaged sewer pipes.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees      Marshall Road Worksite  On or about July 9, 2015 an employee was exposed to cave-in hazards, and slip and fall hazards while climbing the trench side-walls to enter and exit a six-foot deep trench with straight cut earthen walls where a ladder was not provided in the trench for access and egress.

Marshall Road Worksite  On or about July 9, 2015 an employee was exposed to trench cave-in hazards while performing pipe inspection and repair/replacement/relocation activities in a 6-foot, 7-inch deep trench with straight cut earthen walls without an adequate protective system in place.

Marshall Road Worksite On or about July 9, 2015 the top section of a two-piece extension ladder was not inspected to determine the load rating and the manufacturer's instructions for separating the extension sections for separate use.

Marshall Road Worksite On or about July 9, 2015 the employer failed to adequately train employees to recognize hazards related to aluminum extension ladders used for trench access and egress.
