The employee was wearing an N95 respirator.

29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists (ACGIH):    Location: I93 Northbound, New Hampshire    a.  On or about July 15, 2015, an employee operating a router on cracks in asphalt was exposed to respirable silica at an  8-hour time weighted average (TWA) exposure level of 15.5 million of particles per cubic foot (mppcf), approximately 1.6 times the permissible exposure limit (PEL) of 9.43 mppcf.  Additionally, this exceeded the TWA of 1.55 milligrams per cubic meter (mg/m3), approximately 3.7 times the permissible exposure limit (PEL) of 0.425 mg/m3.  These limits are established due to crystalline silica puts workers at risk for silicosis, lung cancer, chronic obstructive pulmonary disease, and kidney disease.  The exposure level was derived from samples collected over a 451 minute sample period.  Zero exposures was assumed for the 29 minutes not sampled.
