Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which is free from recognized hazards that cause or are likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by and/or crushing hazard while stepping on and off moving locomotives. (a) Rail yard: On or about July 21, 2015 and at times prior to, employees were working from a Republic RX500 Industrial Switching Locomotive to move rail cars. Employees were stepping on and off the locomotive while it was in motion. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) Main Maintenance Building: An employee uses a Jet Lathe, no s/n , to turn a shaft. The employees hand was within 4 feet of the unguarded rotating chuck, as determined on or about 08/02/2015. (b) Main Maintenance Building; Welding Area: An employee uses a Jet Drill Press, no s/n, to drill holes for a stabilizer. The employees hand was demonstrated to be approximately 7 inches from the rotating chuck, as determined on or about 08/02/2015. (c) CP3-CP4 Maintenance Building: An employee uses a Clausing Drill Press, s/n 534036, to drill holes into some angle iron. The employees hand was demonstrated to be approximately 4 inches from the rotating chuck, as determined on or about 08/02/2015. ABATEMENT CERTFICATION REQUIRED
