29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about August 11, 2015: a) Integrity Foods, Inc., Athens, GA - On the cook side, an employee working in the freezer room Pack Out was exposed to a noise time-weighted average (TWA) of 88.1 dBA, exceeding the action level of 85 dBA. The exposure was obtained from a sample taken over 463 minutes. Zero exposure was assumed for the unsampled period of seventeen minutes. An effective hearing conservation program was not established. b) Integrity Foods, Inc., Athens, GA - On the cook side, an employee working on the Formax Line was exposed to a noise time-weighted average (TWA) of 90.6 dBA, exceeding the action level of 85 dBA. The exposure was obtained from a sample taken over 456 minutes. Zero exposure was assumed for the unsampled period of twenty-four minutes. An effective hearing conservation program was not established. c) Integrity Foods, Inc., Athens, GA - On the raw side, an employee working on the Grind Line was exposed to a noise time-weighted average (TWA) of 90.1 dBA, exceeding the action level of 85 dBA. The exposure was obtained from a sample taken over 455 minutes. Zero exposure was assumed for the unsampled period of twenty-five minutes.
