29 CFR 1926.1101(f)(1)(iii): The employer did not determine representative 30-minute short-term employee exposures on the basis of one or more samples representing 30-minute exposures associated with operations that were most likely to produce exposures above the excursion limit for employees in each work area: a) On or about June 22, 2015, employees were exposed to asbestos because the employer did not ensure that personal air samples were taken that represented the most likely activities to produce exposures above the excursion limit. No personal air sampling was conducted for the employee who used the grinder to remove flooring adhesive.

General-duty citation text
29 CFR 1926.1101(g)(8)(vi)(B): A competent person did not evaluate the work area, the projected work practices and the engineering controls, and certify in writing, that the different or modified controls were adequate to reduce direct and indirect employeeexposure to below the PELs under all expected conditions of use and that the method met the requirements of this standard. The evaluation did not include and was not based on data representing employee exposure during the use of such method under conditions which closely resemble the conditions under which the method was to be used for the current job, and by employees whose training and experience were equivalent to employees who were to perform the current job: a) On or about June 22, 2015, employees were exposed to asbestos because the employer did not ensure that a competent person performed and certified an evaluation of a work practice which was outside those listed in paragraph (g)(8)(i) through (g)(8)(v). The employer failed to certify that the grinder used to remove flooring mastic/adhesive was equipped with controls that were adequate to reduce employee exposures below the PEL and failed to base the evaluation of the grinder on representative employee exposure data.
