29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Production Chemical Company, Inc. dba Action Painting and Cleaning did not establish and implement a written respiratory protection program with worksite specific procedures where respirators are necessary to protect the health of the employee or whenever respirators are required that includes the following provisions in 29 CFR 1910.134(c)(i)- (ix), as applicable, for employees performing abrasive blasting or spray painting.  The program must be administered by a suitably trained program administrator as well as include: -An established standard operating procedures for selection and use of respirators in the workplace; -Medical evaluations of employees required to use respirators;  -Fit testing procedures for tight-fitting respirators;  -Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations;  -Procedures and schedules for inspecting, discarding or otherwise maintaining respirators; -Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations;  -Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and  -Procedures for regularly evaluating the effectiveness of the program.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Production Chemical Co., Inc. dba Action Painting and Cleaning did not develop, implement, and/or maintain at the workplace an effective written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:   1) Labeling requirements for the containers/packages of the hazardous chemicals, including in-plant secondary containers; 2) Maintenance and availability of safety data sheets (SDSs);   3) Employee training on the hazardous chemicals they use or are exposed to in their workplace;  4) A complete and accurate list or inventory of the hazardous chemicals known to be in the workplace that can be cross-referenced with the required safety data sheets (SDSs);   5) Methods to inform employees of the hazards of non-routine tasks, and   6) Methods to inform other employers/contractors of SDS availability, labeling system and any other precautionary measures to protect employees.    Employees were exposed to hazardous chemicals, such as crystalline quartz silica, which is a carcinogen, and hazardous chemicals contained in paint products, such as PPG PSX 700 resin (containing titanium dioxide, silicon dioxide, aluminum oxide and bis (1,2,2,6,6-pentamethyl-4-piperidyl) sebacate), PPG PSX 700 FD Cure (containing dibutylbis (pentane-2,4-dionato-O,O) tin and proprietary silane), and the Univar Van Blend 99+ solvent (containing acetone, toluene, xylene, n-butyl acetate, methanol and ethyl benzene), and the abrasive blasting agent Black Beauty (containing silicon dioxide, iron oxide, aluminum oxide, potassium oxide, calcium oxide, magnesium oxide and titanium dioxide).   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
