29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): a) On June 22, 2016, Production Chemical Co., Inc. dba Action Painting and Cleaning, did not ensure that employee(s) required to use a 3M 6200 half mask respirator with organic vapor cartridges & P95 filters during spraypainting operations pass the required fit test. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(g)(11): Safety data sheets were not made readily available, upon request, to designated representatives, the Assistant Secretary, and the Director, in accordance with the requirements of 29 CFR 1910.1020(e): a) On August 2 and August 23, 2016 Production Chemical Co., Inc. dba Action Painting and Cleaning, did not make available, when requested, the Safety Data Sheets for the chemicals, including Sherwin Williams Fast Clad DTM, recoatable epoxy and primer containing 9% xylene & 2% ethyl benzene; Sherwin Williams Macropoxy 646, Sherwin Williamx Hi Performance Epoxy; Carboline Carbothane 8815 containing 10-25% microcrystalline silica, n-butyl acetate, MEK, carbon black, metaxylene & ethylbenzene; Carboline Carboguard 890 & 890N; Carboline Carbothine 134HG, and Carboline Carbomastic 15. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
