OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:       a) Pennsylvania Sintered Metals, Inc. dba PSM Brown Co. / 2950 Whittimore Road, Emporium, PA: On or about July 29, 2015, and at times prior there to, employees were exposed to crushing and amputation injuries due to a lack of machine guarding at the point of operation on a powdered metal press during sizing operations.  Sizing operations were conducted on #7 Gasbarre 60 ton powered metal (P/M) press serial number 98931 without the use of guards, barriers or controls at the point of operation.          b) Pennsylvania Sintered Metals, Inc. dba PSM Brown Co. / 2950 Whittimore Road, Emporium, PA: On or about July 29, 2015 and times prior thereto, employees were exposed to crushing and amputation injuries at other hazard areas of the powdered metal (P/M) presses. Other hazard areas include moving and rotating mechanical components behind the P/M presses such as the feed shoe, the flywheel and associated components. P/M presses inadequately guarded at other hazard areas includes, but is not limited to, #2 Gasbarre 30 ton P/M press and #8 Gasbarre P/M press.

The lockout/tagout procedures were generalized to all the Gasbarre P/M presses and did not include specific information regarding the removal and transfer of lockout devices or tagout devices and the responsibility for them; specific procedural steps for testing machines and equipment to verify the deenergization; specific requirements for notification of affected employees prior to work commencing; and specific procedures for reenergization of the machines.
