29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:     a- Bridge 1 - North West Side of Bridge: On or about 07/31/15, company employees installing sections of a prefabricated wall with the use of an Caterpillar 328D excavator were exposed to struck by and crushing hazards when the excavator was being operated with one of the tracks partially over the unprotected edge of the excavation.  The soil beneath the excavator's tracks showed clear signs of ravelling.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a- Bridge 1 - North West Side of Bridge: On or about 07/31/15, company employees were exposed to struck by and crushing hazards when the excavator was being operated with one of the tracks partially over the unprotected edge of the excavation.  The soil beneath the excavator's tracks showed clear signs of ravelling.  As such, the worksite competent person did not remove the exposed employees from the hazardous area.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
