29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards: Note: Toe boards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. (a) Facility, 843 Freeport Road, Pittsburgh, PA: On or about July 28, 2015 the upper storage loft was not guarded by standard railings constructed in accordance with paragraph e. There was no swinging gate or an offset at the opening. Another section of the railing system had 4 barrel locks installed, two at each end next to the posts. An employee was in the upper loft and attempted to hand product over the rail to a person below when this section of railing gave way and the employee fell approximately 9 feet to the floor below sustaining leg fractures.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate: (a) Facility, 843 Freeport Road, Pittsburgh, PA: On or about July 30, 2015 there were no plates affixed that listed the floor load approved for the upper storage area. Stock such as lamps and outdoor furniture was stored in the loft area above the offices and there was no way of knowing the capacity to ensure the area was not overloaded.
