29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): On or about July 29, 2015, the employer did not identify the types of hazardous environments to which a fire fighter member might be exposed and did not determine the protective clothing to be worn during different types of fire fighting operations, such as, but not limited to, scrap fires, and/or interior structural fires, exposing employees to the hazards of fires and/or explosions.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include at least the measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used: On or about July 29, 2015, employees responding to a scrap fire and assisting the fire department in their firefighting efforts were exposed to potential hazards in that they did not have specific training for the emergency operations in which they were to participate, specific roles or duties, or the use of personal protective equipment that may have been required.
