OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of ejection and crush-by.    a)  Throughout jobsite-On or about July 27, 2015, an employee was operating a GENIE GTH-844 forklift without the use of seatbelts, exposing the employee to ejection, and others to struck-by and crushing hazards.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:     a) Scaffold Area  July 27, 2015, employees were working from scaffolding installing brick and performing other overhead work while other employees were allowed to work below and nearby without head protection, exposing employees to struck-by hazards.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not netralized, power was not shut off, and brakes set.    a)  Jobsite-On or about July 27, 2015, the operator of a GENIE-844 forklift (PIT) left the forklift unattended, was more than 25 feet away, left the load engaging means in an elevated position, and the engine was not shut off, exposing employees to inadvertent movement of the forklift.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    a)  Jobsite-On or about July 27, 2015, employees were allowed to use cross bracing and scaffold up-rights to ascend and descend the scaffold system, exposing employees to fall hazards up to 19 feet.

29 CFR 1926.451(g)(1)(v): Each employee on a walkway located within a scaffold was not protected by a guardrail system (with a minimum 200 pound toprail capacity) installed within 9.5 inches (24.1 cm) of and along at least one side of the walkway.  a) Jobsite-On or about July 27, 2015, employees using scaffold walkways to transition between tubular welded frame scaffold systems were not provided with an adequate guardrail in that a large gap was left open at the corner, exposing employees to fall hazards up to about 19 feet.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  a) Jobsite-On or about, and at times prior to July 27, 2015, the employer allowed employees to work from the 3rd tier tubular welded frame scaffolding with exposed open sides and ends.  The employer failed to ensure fall protection was provided such as, but not limited to guardrails, exposing employees to fall hazards up to 19 feet.
