29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels and 50-feet (15.25 m) wide or less, was not protected from falling by guardrail systems, safety nets:   a.  On August 6, 2015, on the rooftop of the Herman's Modern Bakery Apartments, employees performing roofing activities were not protected from falling.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)   a.  On August 6, 2015, employees working from elevations such as roofs were not trained in the recognition and the avoidance of unsafe conditions and the methods to minimize those hazards.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:   a.  On August 6, 2015, at the rear of  the Herman's Modern Bakery Apartments (2nd floor), an 8 foot Werner fiberglass stepladder used to gain access to a concrete awning did not extend at least 3 feet above the concrete awning, and there was no grab rail at the top of the concrete awning.

On August 6, 2015, three employees ascending and descending from a 8 foot fiberglass stepladder were not trained about the hazards and the methods to minimize those hazards.
