29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On the North side of the building under construction: On August 11, 2015 and at times prior to; the employer exposed his employees to struck-by hazards in that employees standing next to a scaffold that was being dismantled, were not protected from 2 X 4 lumber and metal cross braces that were being thrown down from the scaffold.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) At the worksite: On August 11, 2015 and at times prior to; the employer exposed himself and his employees to chemical hazards from exterior concrete plaster and gasoline in that the employer did not develop a hazard communication program that included training, Safety Data Sheets (SDS) and how they are to be used.
