29 CFR 1926.304(d): Each portable, power-driven circular saw withdrawn from the work did not automatically and instantly return the lower guard to the covering position of the saw.  At a residential construction site, employees performing framing work were using a circular saw with the lower blade guard wedged in the up position while cutting framing material exposing the employees to amputation hazards.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  At a residential construction site, employees performing framing work were not protected by a protective helmet while working underneath employees that were framing above at higher levels. The employees were exposed to being struck by objects and/or tools falling from a height greater than (8 to 15) feet.  Mr. Jose Juan Deleon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 889003, citation number 1, item number 1 and was affirmed as a final order on February 14, 2013 with a final abatement date of February 19, 2013 with respect to a workplace located at 12926 Flat Iron Trail138 Rolling Fork, Irving, Texas 75062.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  At a residential construction site, employees performing framing work using circular saws and air nail guns were not provided eye and face protection exposing them to eye and face injuries.  Mr. Jose Juan Deleon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 889003, citation number 2, item number 1 and was affirmed as a final order on February 14, 2013 with a final abatement date of February 14, 2013 with respect to a workplace located at 12926 Flat Iron Trail 138 Rolling Fork, Irving, Texas 75062.  Mr. Jose Juan Deleon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 549078, citation number 2, item number 1 and was affirmed as a final order on November 19, 2012 with a final abatement date of December 24, 2012 with respect to a workplace located at 220 Rolling Fork, Irving, Texas 75062.  Mr. Jose Juan Deleon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 314182890, citation number 1, item number 1 and was affirmed as a final order on June 3, 2011 with a final abatement date of June 13, 2011 with respect to a workplace located at 73389 Comal Drive, Irving, Texas 75062.
