29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure to blood-borne pathogens:  a) The employer did not establish a written exposure control plan for staff assigned to perform duties including, but not necessarily limited to, phlebotomy, suturing and/or bandaging of wounds, and handling of contaminated instruments; where there is reasonably anticipated contact with blood or other potentially infectious materials.  Condition(s) existed on and before 8/17/2015.  **NOTE** An exposure control plan shall include: 1) List(s) of job classifications in which all or some employees have occupational exposure, as well as a list of tasks & procedures in which occupational exposure occurs;  2)  Procedure for evaluating exposure incidents; and 3) The schedule and method for implementation of the provisions in paragraphs (d) through (h) of the standard.

Condition(s) existed on and before 8/12/2015.  **Note**  Does not apply to employees who have previously received the complete hepatitis B vaccination series, for whom antibody testing has indicated immunity, or for whom the vaccine is contraindicated for medical reasons.

29 CFR 1910.1030(g)(2)(i): The employer did not ensure that each employee with occupational exposure participated in a training program:  a) The employer did not furnish training on preventing blood-borne pathogens infection to each employee with occupational exposure; by virtue of assigned tasks like phlebotomy, suturing and/or bandaging of wounds, and handling of contaminated instruments.  Blood-borne pathogens training was not provided to each such staff member prior to initial assignment to tasks involving occupational exposure, and at least annually thereafter to include: access to a copy of the OSHA standard (29CFR 1910.1030), modes of transmission of blood-borne pathogens, an explanation of the workplace exposure control plan & methods established for preventing or reducing exposure, and procedures for reporting an exposure incident.     Condition(s) existed on and before 8/17/2015.
