29 CFR 1910.107(g)(2): Cleaning. All spraying areas must be kept as free from the accumulation of deposits of combustible residues as practical, with cleaning conducted daily if necessary. Scrapers, spuds, or other such tools used for cleaning purposes must be of non-sparking material.  a) On or about September 1, 2015, the employer failed to maintain the dry overspray paint booth free of accumulation of combustible paint residues; the CSHO observed a thick accumulation of paint deposits on the interior of the booth walls, floors and behind the filters.  Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer must establish and implement a written respiratory protection program with worksite-specific procedures. The program must be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer must include in the program the following provisions of this section, as applicable:  a) The employer failed to establish and implement a written respiratory protection program where respirator use was  required by the employer when cleaning the wave solder machine.  b) The employer failed to establish and implement a written respiratory protection program where respirator use was  required by the employer when spray painting or working near the spray painting operation.  Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. 29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified:    a) The employer failed to select appropriate types of gloves that will protect painters from the hazards associated with paints, paint thinners and paint clean-up. Chemicals such as xylene, toluene, methyl ethyl ketone and ethyl benzene were used. 29 CFR 1910.141(g)(2): Employees were permitted to consume food or beverage in area(s) exposed to toxic materials:  Parker McCrory Mfg failed to protect employees from consuming food or beverages in areas exposed to toxic materials. This was most recently documented in the following instances:  (a) On or about August 13, 2015, at the Electrovert MiniPak 300 wave solder machine, a wipe was taken on the out-feed 'catching' surface. Lead was present.  (b) On or about August 13, 2015, at the Electrovert MiniPak 300 wave solder machine, a wipe was taken at the front of the Electrovert MiniPak 300 solder wave solder machine, under the chamber. Lead and arsenic were present.  (c) On or about August 13, 2015, from the surface of a desk, left of the Electrovert MiniPak 300 wave solder machine, a wipe was taken. Lead was present.  (d) On or about August 13, 2015, at the Electrovert MiniPak 300 wave solder machine, a wipe was taken on the table near the in-feed of the Electrovert MiniPak 300 wave solder machine. Lead was present.  Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
