Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using a step ladder to access and egress an elevated conveyor.     In the Milnor dryer area, employees used a Keller fiberglass step ladder to gain access to the Pellerin Milnor conveyor at the #11 Milnor dryer location to perform maintenance work on the dryer. The employee climbed over the conveyor side shield that was approximately 27-inches high and was exposed to a fall hazard of over 8-feet to the concrete floor below.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  (a) On or about August 13, 2015, in the Milnor dryer area, on the conveyor between Dryer # 11 and Dryer # 5, an employee was standing on an 8-foot high conveyor belt near the edge without being protected by a railing system or equivalent type of fall protection.   (b) On or about August 11, 2015, in the Milnor dryer area, on the conveyor between Dryer # 11 and Dryer # 5, an employee was standing on an 8-foot high conveyor belt near the edge without being protected by a railing system or equivalent type of fall protection.

29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to Items of this section:   (a) The employer did not ensure that specific procedures such as, but not limited to, rules, techniques, and purpose were developed for the control of hazardous energy for equipment such as, but not limited to, the Milnor dryer and Pellerin Milnor conveyor. On or about August 13, 2015, an employee was propelled into an industrial dryer when the conveyor system activated. The dryer subsequently activated with the employee trapped inside.   (b) The employer did not ensure that specific procedures such as, but not limited to, rules, techniques, and purpose were developed for the control of hazardous energy for equipment such as, but not limited to, the Milnor dryer and Pellerin Milnor conveyor. On or about August 11, 2015, an employee was conducting maintenance work without using proper hazardous energy control procedures.
