29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) 600 Maxwell Boulevard, Montgomery AL; On or about August 11, 2015 and at times prior thereto the controlling employer Cornerstone Drywall and Paint, Inc. failed to ensure that its sub-contractor Raoul Somoza protected its employees from fall hazards in that employees were allowed to work on the fourth level of an apartment building balcony that had an unprotected edge exposing employees to a 31 foot 11 inch fall to the next level.
