Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from recognized struck-by and/or crushed-by hazards that are causing or likely to cause death or serious physical harm to his employees: This violation was observed on or about August 28, 2015, in the warehouse; where employees were exposed to being struck-by and/or crushed by falling objects caused by: a) Storage racks not being anchored to the ground. b) The storage rack system did not have plaques containing the maximum permissible unit load and/or maximum uniformly distributed load per level, and/or the racking system did not have the maximum total load per bay. c) The storage rack system showed damage to the lower area rack columns.

Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc. The employer did not ensure employees were protected from slips, trips and/or falls. This violation was observed on or about August 28, 2015. a) Employees working in the unloading area were exposed to slip, trip and/or fall hazards while working around an open hole that measures approximately 2-feet wide, 6-feet in length, and depth level ranged from 3-feet to 9-feet.

29 CFR 1910.24(h): "Railings and handrails." Standard railings were not provided on the open sides of all exposed stairways and stair platforms. Handrails were not provided on at least one side of closed stairways preferably on the right side descending. Stair railings and handrails were not installed in accordance with the provisions of 1910.23. The employer did not ensure employees were protected from falling to the ground level below. This violation was observed on or about August 28, 2015. a) Employees using fixed industrial stairs leading to catwalk located above the feeder to hoppers in the production area were exposed to falling; b) Employees working in the blending area used a set of steps leading to a stair platform exposing employees to a fall hazard.

This violation was observed on or about August 28, 2015. a) At least one (1) Master and one (1) Sentry fire extinguisher (5 lbs. each) was located outside the supervisors office without inspection tags; b) At least one (1) red fire extinguisher bag was located on the rear wall in the production area where live wires were exposed; c) At least one (1) Sentry fire extinguisher (5 lbs.) was located at the rear overhead door leading to the staging area; d) At least one (1) Ansul Sentry fire extinguisher (5 lbs.) located in maintenance shop had tag showing inspect without date that was near flammables.

This violation was observed on or about August 28, 2015. a) In production area two electrical junction boxes mounted on wall behind dimension tanks had exposed electrical wires exposing employees to electrical shock and/or electrocution. b) In the production area one electrical box mounted to a motor on the floor had wires exposed where employees walked and were exposed to electrical shock and/or electrocution.
