29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   At the time of the inspection on or about 29 August 2015, five (5) employees working for Carlos Fuentes were observed working on a residential roof located at 2354 S. 10th St., Saint Louis MO without the use of adequate fall protection. All employees on the roof were engaged in tear off of layers of roofing material while on top of the building that measured 30 feet from the ground to the eave with a pitched slope roof above 4/12, height and pitch were confirmed by the owner, Carlos Fuentes.
