29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  On or about August 27, 2015, at 5020 Cromwell Dr., Kyle TX, an employee was dry cutting Allura Fiber cement siding when the employer had not conducted an assessment for respiratory hazards. Employees exposed to an inhalation hazard to silica dust.

On or about August 27, 2015, at 5020 Cromwell Dr., Kyle TX, the employer failed to ensure that the guardrail system installed was erected along the open sided platform. The guardrails were erected with a sizeable gap between the end of the work platform and the railing. Employees were exposed to a fall hazard of approximately 24 feet.

29 CFR 1926.451(b)(3): The front edge of all platforms was not 14 inches (36 cm) or less from the face of the work, and no guardrail systems were erected along the front edge and/or no personal fall arrest systems were used in accordance with paragraph (g) of this section to protect employees from falling:  On or about August 27, 2015, at 5020 Cromwell Dr., Kyle TX, the employer failed to ensure the pump jack system was installed not more than 14 inches from the building. The employees were nailing hardy plank on the side of the building. The pump jack system near the push out of the building was installed approximately 24 inches away from the building. The employees exposed to a fall hazard of approximately 24 feet.

For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall:  On or about August 27, 2015, at 5020 Cromwell Dr., Kyle TX, the employer failed to ensure the boards were erected to prevent tools and materials from falling on workers below. Employees on the pump jack scaffold were using pneumatic nail guns and hardy plank siding. Employees exposed to the hazard of being struck by material and/or the air guns falling approximately 24 feet.
